There is no escaping the extensive legal requirements. Those involved in this process must ensure they are up to date with important developments and changes regarding planning and environmental law, in order to successfully navigate the planning process and avoid costly mistakes. It is also important that planners keep one eye on what will be coming down the tracks, in order to be prepared for any potentially significant changes. 

This course will discuss important recent and upcoming developments, such as the new EIA Regulations that came into force on 1st of September, key changes made by the Planning and Development (Amendment) Act 2018 as well as recent European Court decisions relating to EIA and the Habitats Directive (People Over Wind, Grace & Sweetman, Holohan, NEPPC and Klohn) and several decisions of the Irish Courts on planning and waste enforcement. Attendees will leave with a full course pack and with 5 structured CPD points to add to their yearly requirements. 

The pace of change in environmental and planning law is fast. This session has been designed to get you up to speed on the changes made in the last twelve months.  During the day, you will cover more than 100 different cases, laws and policy interventions.  The trainer will focus on those topics of most interest to those attending.

  • New amendments to the Environmental Impact Assessment Directive

  • Recent references to the Court of Justice made by the Irish Courts, including
    – People Over Wind v. Coillte, about mitigation measures and screening for appropriate assessment
    – Grace v. An Bord Pleanála, about compensatory measures and appropriate assessment
    – Holohan v. An Bord Pleanála, about main alternatives, baseline data, recording an assessment
    – North East Pylon Pressure Campaign and Klohn, about access to justice and costs

  • Recent Court of Justice decisions on EIA and the Habitats Directives

  • Enforcement proceedings by the European Commission against Ireland

  • New strategic housing consent process with An Bord Pleanála

  • Recent Irish Cases will be discussed throughout the day, including:
    – The fallout from O’Grianna
    – The Corrib Gas Project
    – The North South Interconnector
    – The Apple Data Centre
    – Windfarms nationwide
    – Solar power projects
    – The Whitestown dump
    – Odour nuisance from landfill
    – Planning enforcement
